These Terms of Service ("Terms") are a binding agreement between you and DotPlus Technologies Private Limited, a company incorporated in India ("Daakiaa", "we", "us"), for the use of the Daakiaa email service, its websites, apps and partner consoles (the "Service"). If you sign up for a company or organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" means that organisation and every person it gives a mailbox to.
Please read the Acceptable Use Policy and section 5 carefully. Sending spam or misusing the Service leads to immediate suspension and may lead to civil and criminal legal action against you.
1. Who may use Daakiaa
- You must be at least 18 years old and legally able to enter into a contract under Indian law.
- You may only add domains that you own or are authorised to manage.
- You must give true, complete and current information, and keep it up to date.
2. Account verification (KYC)
- To keep the Service free of spam and fraud, new accounts are verified before mail service is switched on: an individual provides the front and back of their Aadhaar card; a business or organisation provides its GST registration certificate and GSTIN or, if it has no GST registration (for example a school, college, trust or society), another registration document issued or approved by a government body.
- We may approve or refuse any verification at our sole discretion, without giving reasons, and may ask for verification again at any time.
- Submitting a false, forged, altered or someone else's document is a serious offence. We will close the account immediately, keep the records, and report the matter to the police and other authorities.
3. Your responsibilities
- You are fully responsible for all activity in your account and in every mailbox you create, including what your users send and receive.
- Keep passwords, passkeys and recovery codes secret, use 2-step verification, and tell us at once at support@daakiaa.com if you suspect unauthorised use.
- You must follow our Acceptable Use Policy, which is part of these Terms, and all applicable laws, including the Information Technology Act, 2000 and the rules made under it, and the Digital Personal Data Protection Act, 2023.
- You must have every right and consent needed for the email addresses you write to and the content you send.
4. Zero tolerance for spam
Daakiaa is for genuine business communication. Unsolicited bulk or commercial email ("spam"), purchased or scraped mailing lists, phishing, and mail that hides or fakes its sender are strictly forbidden. Every plan has daily sending limits, and we watch sending volume, bounces, complaints and blocklist reports (not the content of your mail) to find abuse. We may hold, slow down or stop outgoing mail at any time to protect the Service and other customers.
5. What happens if you misuse the Service
If we believe, in our sole judgement, that you or any of your users have broken these Terms or the Acceptable Use Policy, we may, without notice and without refund:
- suspend or permanently close the account, its mailboxes and its domains;
- stop or delete mail waiting to be sent, and block the domains and people involved from ever using the Service again;
- keep the related records, logs and documents as evidence;
- report the matter to, and share the records with, the police, CERT-In, the Cyber Crime cell and other competent authorities, and cooperate fully with any investigation;
- take civil and criminal legal action against you, including under the Information Technology Act, 2000 (including sections 43, 66, 66C and 66D) and the Bharatiya Nyaya Sanhita, 2023, and claim our losses.
You will pay us for all losses, costs and damages that your misuse causes, including the cost of removing our servers and IP addresses from blocklists, lost business, claims by third parties and reasonable legal fees.
6. Indemnity
You agree to defend, indemnify and hold harmless DotPlus Technologies Private Limited, its directors, employees and partners from any claim, demand, penalty, loss or expense (including legal fees) that arises from your use of the Service, your content or mail, your breach of these Terms or of any law, or the acts of your users.
7. Plans, limits and payment
- The Free plan is free and comes with the limits on our pricing page. We may change or end the Free plan, and may close Free accounts that are unused for a long time, after giving notice by email.
- Paid plans are charged per mailbox per month as shown on the pricing page, plus applicable taxes (GST). Unpaid accounts may be suspended.
- Limits (mailboxes, storage, emails per day) are part of your plan. Trying to get around them, for example by opening many accounts, is a breach of these Terms.
8. Your data
Your mail belongs to you. We handle personal data as described in our Privacy Policy. You can export your mail at any time over standard protocols (IMAP). When an account is closed, its mail is deleted after a reasonable period, except records we must keep by law or as evidence of misuse.
9. Daakiaa as an intermediary
Daakiaa provides email hosting as an intermediary under section 79 of the Information Technology Act, 2000, and follows the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We do not create or check the content of your mail, and you alone are responsible for it. On receiving actual knowledge through a court order or a notice from an authorised government agency, or a valid complaint, we will act on unlawful content as the law requires.
10. Service and liability
We work hard to keep Daakiaa fast, available and secure, but the Service is provided "as is" and "as available", without warranties of any kind. To the extent the law allows, we are not liable for indirect, incidental or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 3 months before the claim (nil for the Free plan).
11. Ending the Service
You may stop using Daakiaa at any time. We may suspend or end the Service for you under section 5, if required by law, or with 30 days' notice for any other reason.
12. Changes
We may change these Terms. We will publish the new version here and, for important changes, tell account administrators by email. Continuing to use the Service after a change means you accept it.
13. Law and disputes
These Terms are governed by the laws of India. The courts at the place of the registered office of DotPlus Technologies Private Limited have exclusive jurisdiction.
14. Trademarks and comparisons
Daakiaa and the Daakiaa logo are trademarks of DotPlus Technologies Private Limited. Other names on our website and in our product, such as Google Workspace, Gmail, Android, Microsoft 365, Outlook, Zoho, Zoho Mail, Apple Mail, iPhone, Thunderbird and Cloudflare, are trademarks of their respective owners. We use them only to name those products, to explain compatibility (for example, that a mail app works with Daakiaa) and to compare services fairly. This does not mean that any of those companies is affiliated with, sponsors or endorses Daakiaa. Comparisons are based on information the providers published on their own websites on the date shown; their plans and prices can change, so please check their current terms. If you believe something on our website is inaccurate or uses your trademark wrongly, write to support@daakiaa.com and we will review it promptly.
